Changing Employers With a Work Permit: How to Reissue the Paperwork
Why a new job means more than a new employment contract
A work permit for a foreign worker is issued for a specific employer and a specific position, not to the worker personally as a general-purpose document. That means signing an employment contract with a new company doesn't, by itself, make the worker's stay legal in the new role — the permit itself has to be amended or reissued for the new employer.
Whose job it is to reissue it
The obligation to file for changes to the work permit sits with the employer, not the worker. For a new employer, that means legalizing someone who is already in Ukraine on a valid basis still requires a separate filing with the State Employment Service — even though the person already holds a valid permit issued for their previous employer.
Timelines, and what delay actually costs
Amending a work permit after a change of employer or contract terms has to happen within the legally set deadline from when the grounds for the change arose. If the employer misses that window, it's the employer that's liable for the breach of employment law — the risk sits with the company, not with the worker personally.
What happens to the residence permit
If a work permit was the basis for a residence permit, changing employers usually means that basis needs updating too — the residence permit has to reflect the worker's current status, not outdated information about a company that's no longer their employer. That's a separate step from amending the work permit itself, and it's easy to miss.
What documents the new employer needs
The new employer needs the worker's valid permit, a copy of the new employment contract or an amendment covering the move to the new role, plus the standard company document package used for an initial permit application. How complete that package is directly affects whether the review goes through without extra requests from the employment service.
Getting ahead of it
The best time to start reissuing is before the worker actually starts at the new job, not after. Document renewal from ASHA Ukraine handles the entire process of amending a work permit, and work permit services help a new employer get the full document package right the first time.
